On July 19, 2022 the CHRC acknowledged receipt of Danas’ complaint. They notified her that there were 2 outstanding issues that had to be addressed before they would decide whether to allow it move forward within the complaint process. Those issues were:
- Were the grievance or review procedure(s) that can deal with these allegations exhausted?
- Why was the complaint not filed within one year of the alleged discrimination?
Over the next few months there were a few email exchanges while Dana worked to provide information related to these questions. On January 17, 2023, after reviewing submissions by both parties, a ruling was issued in her favor. In this decision, the Commissioner held that the complaint could proceed!
